1. Scope

These General Commercial Terms and Conditions apply to all the orders and deliveries between Lords.es, C/ Gomera, 2 cd. 30740 San Pedro del Pinatar (Murcia)

and their customers on the online store: www.lords.es

2. Placing orders, contract and limitation of amounts

Placing orders

Buying on our online store is very simple. You just need to choose an item, add it to the basket by clicking on the cart icon and process the order by using the method of payment you prefer. Customers may access a summary page by clicking on the shopping cart button shown in the upper right corner of the online store, and at any time, they can check the products that have been added in the shopping cart and make any changes they need.

If customers do not wish to buy more products, they can continue by clicking on the “process order” button, which takes them to a purchase summary.

Registered customers can enter their username and password at this time to use their saved order information automatically. All other customers must register in order to start a purchase process. In this step, new customers will provide their necessary data to let us know their invoicing and shipping address.

By clicking on the “continue” button, customers access the penultimate step of the order, “transports”. Here, customers will know the cost they are required to pay for shipping their order.

In the last step, customers have access to a summary of their order that includes the price (including VAT) and delivery service details and their cost. In addition, many forms of payment are offered, from which they will be able to choose the most suitable for their needs.

The order ends by clicking on the “Pay” button on the payment screen. This means that a binding offer has been made.

The price of our items and services can be viewed at all times on our website and includes VAT.

If an error is detected while entering the price of an item after receiving an order, we will contact you as soon as we can to inform you about the issue and offer you the option to cancel or keep it in the right conditions. Submitting an automatic confirmation does not validate the faulty price conditions. In the event of cancellation, all the amounts paid will be refunded to you. We will only dispatch your order with your express agreement to the correct price conditions.

The products offered in this service are addressed to final consumers in the terms and conditions specified by the Spanish Retail Trade Act.

Contract

The range of images on the store are thought to serve as illustrations and do not intend to be binding offers for sale. Customers are required to make a binding offer to make a purchase agreement when completing the order process by clicking on the "Pay" button. Customers will later receive an automatic confirmation of the order entry by e-mail (order confirmation). The agreement with Lords.es will only be concluded if Lords.es sends all the ordered products to the customer and the order is confirmed by e-mail (order confirmation).

3. Prices and shipping costs

Prices

All prices include legal Value Added Tax (VAT) and other price elements, and need to be understood beyond the shipping costs that may incur.

Shipping costs

The preferred courier service we currently use for the Spanish national territory is DHL.

4. Delivery

The order delivery for the Iberian Peninsula, as a rule, takes between 2 to 5 working days from the time the order has been placed on our store.

For shipping to destinations like the Canary Islands, a SAD (single administrative document), for the import or export declaration before the customs authorities will be added. The tax will rise to 12.5 euros per shipping and it is already calculated in our store for customers with this destination.

We accept shipping orders to other countries, for which before placing the order on the web portal, you will have to send us an email to info@lords.es mentioning your purchase intention, your personal details and delivery address. Then, we will send a budget that will include the price of the materials, shipping charges and delivery date, which you will have to forward with your acceptance to info@lords.es. Next, you will be able to make the purchase on our online store.

Issues

If you receive a wrong order that does not match to the one you placed, Lords.es will resend you the right products to your address without additional transport costs or will reimburse the amount to the credit card you used to pay for the order or will make a bank transfer.

In case you see any damage on the package or load of the goods the carrier delivers to you, please let them know and mention it on the delivery note, so that we can process your timely complaint with the agency.

In order to process any issue related to shipping, it is essential to send a previous written notice to our company.

In the event that Lords.es is not able to deliver the requested product because the goods from their supplier were not received, without their guilt, Lords.es can terminate the contract. In such case, Lords.es will have to let the customer know as soon as possible and propose a comparable product. If no similar product is available or the customer does not wish to receive that product, Lords.es will have to reimburse the payments made by the customer immediately.

5. Right of ownership

Products remain the property of Lords.es until the total payment has not been made. Before the property transfer takes place, the pledge, transfer of property as a guarantee, handling or redesign is not allowed unless approved by Lourdes Jerez García

6. Right of withdrawal

Consumer customers have the right to cancel the purchase within 14 days. Consumers are any legal person who makes a legal transaction with an intention that is not attributable to the commercial or entrepreneur activity thereof. The following regulations apply to the right of cancellation or exclusion of this right thereof. If consumers have any doubts regarding the cancellations, they can contact the Lords.es Customer Service.

Instructions for exercising the right of withdrawal for consuming customers

You have the right to withdraw from this contract within a period of 14 days without having to justify. The withdrawal term will expire in the next 14 calendar days from the day you or a third party referred by you, that differs from the carrier, acquires the material possession of the last goods (if the term ends on Saturday, Sunday or a holiday, it will be extended to the following working day).

In order to exercise the withdrawal right, you will have to give notice to Lords.es, account holder of www.lords.es,

C/ Gomera, 2 cd. 30740 San Pedro of the Pinatar (Murcia), by phone at 629140785 or by e-mail to info@lords.es about their decision to terminate the contract through a clear statement (for example, a letter sent by post or e-mail). You can use the withdrawal form, although you are not obliged to.


You can also fill in and send the withdrawal form or any other clear statement electronically via our website: https://www.Lords.es.com/contacto. If you choose this option, we will give you notice of it immediately in a durable medium (for example, by e-mail) about the reception of this withdrawal.

In order to meet the term of withdrawal, it is sufficient that you send the communication related to the exercise of the withdrawal right before the term of withdrawal expires.

Withdrawal consequences of the consuming customer

In case of withdrawal on your behalf, we will return all the payments received from you, including delivery expenses (with the exception of the additional expenses resulting from the delivery method of your choice that differs from the less expensive method of the standard delivery we offer). We will go ahead and proceed with the mentioned refund used by the same method of payment you used for the initial transaction, unless you have expressly provided otherwise, in any case, this shall not involve in any costs resulting from the refund.

Without undue delay and, in any case, for no more than 14 days from the date you should let us know about your decision to withdraw from the contract.

The term will be considered as fulfilled if the goods are returned within a period of 14 days in its original package and in perfect condition.

By rule, we will not assume the costs of returning of the goods and you will be responsible for the decrease in value of the goods resulting from handling that may differ from the necessary one to create the nature, characteristics and operation of the goods.

Exclusion of the withdrawal right

The withdrawal right is not applied in the case of goods:

- when they are not pre-produced and they are selected or manufactured according to the customer's specifications or exclusively according to their own requirements.

- when after the delivery, they have been mixed irreversibly with other products

- when the products have been tampered, altered or used.

7. Guarantee and Responsibility

Lords.es reserves to the faculty and right to modify the conditions of all the items that appear in our online store. These items have a minimum warranty period of 2 years and in their case, the one issued by each manufacturer and effective legislation.

The damage caused by lack of conservation, illegal negligence, blows, improper use, connecting to the mains on a non-suitable voltage, illegal fuel use or materials and equipment put to efforts or applications non-recommended by the manufacturer are excluded from the warranty.

Items that under warrantee experience an abnormal operation, will be taken to repair or will be replaced at no cost, to comply with item 120 of the General Law for the Protection of Consumers and Users of the Consumers and Users and other complementary laws. This gratuity will include the necessary expenses made to remedy the lack of conformity of products with the contract.

The warrantee period will end when:

- The item lacks the corresponding invoice of purchase or has been tampered.

- The item has been altered, tampered or repaired by external personnel other than the Manufacturer's Technical Service.

- The item has been deteriorated when installed or used.

Use of the warranty

If the repair or replacement of the item is not covered by the warranty in the established terms, all expenses will be on the customer's cost.

Nevertheless, according to Spanish Law 23/2003 July 10th, on Warranties in the Sale of Consumer Goods, will be presumed that all the defects or non-conformity with the supply that are expressed within the first 6 months, are due to manufacturing errors, and in such case, the responsible party for them is the product's brand. For errors, failures or deficiencies as of this date customers will be responsible for demonstrating that they are manufacturing errors and are not caused by use.

Product's specifications and dimensions

When the requested products are not available, but only others of identical or higher, comparable or compatible quality to the requested products, Lords.es will be able to replace them by those products, after having previously letting you know by e-mail and receiving your acceptance. The displayed photos do not have to correspond exactly with the models offered.

Price of items

The prices that appear in all our products include the applicable legal VAT.

All our products shown on the web portal are available. At the moment when an order of any product is placed and it is out of stock, without having been able to update our supply, our commercial service will contact you as soon as possible to let the customer know and propose them other similar alternatives. In case they are not interested, the amount thereof will be refunded immediately.

8. Payments, lack of payment and discount vouchers

The buyer will have to pay the product price prior to delivery by credit or debit card (Visa, Mastercard and American Express), by bank transfer or Paypal. Check or cash payments will not be accepted. In this case, Lords.es is not responsible for any type of loss. Lords.es reserves the right to accept only certain methods of payment in particular cases or depending on the type of shipping customers select.

PayPal

PayPal is an online payment service that guarantees a safe, fast and easy payment using a credit, debit card or bank account. While you place an order, you have the possibility to open a PayPal account. When sending a payment with PayPal, the recipient will never see your financial details, as well as your card or bank account number

Credit / debit card payment

Debit/credit card payments are made surely through our safe Virtual TPV of Sabadell Banc, in order to make the payment with total security. We do not store any card number and all the payment process is made through Sabadell Banc.

Cash on delivery payment

You can pay in cash directly when receiving the shipping. Only for deliveries by DHL and orders over 500€. This method of payment carries a supplement of 3% on the amount of the order. The minimum supplement by shipping will be 2.50 euros (VAT included).

Certain products of the range do not admit this method of payment.

9. Data protection

Visiting this website does not imply that users are forced to provide any information. In case users facilitate any personal information, the data collected in this website will be treated faithfully and will be lawfully subject at all times to the principles and rights in accordance to Organic Law 15/1999, of the 13th of December, the Personal Protection Data (LOPD), and other development regulations.

- Banking Organizations for the payment of the purchases made by card.

- Consumer's and Users Organization in case of any existing complaint.

- Manufacturers, wholesale services and/or whole sellers in the case of guarantees or repairs. These recipients can be located within the Spanish territory as well as outside, based on the product and/or service acquired.

- Under any other circumstance set out in law, as it is the case of the security forces and bodies.

11. Final Provision

In the event that any general provision contained in these Terms and Conditions, is invalid, or unenforceable, the validity or enforceability of the other provisions of these Terms and General Conditions will not be affected by them.

To the transactions that are made bases on the current table of general conditions will be apply to the Spanish legislation, regardless of the destination of the orders and in accordance to the current provisions at any stage at a statewide level.
